*Terms of Use*

Please actually read the following Terms of Use carefully, as they are important and affect your rights.

These Terms of Use serve as your contract for participation in the Fall Foundation Series of the Second Saturday Workshops (hereinafter, "the Workshops"), which are created and operated by Personal Empowerment Services, LLC. In the these Terms of Use, the term "PES LLC" refers to Personal Empowerment Services, LLC, along with its owners, employees, contractors, agents, successors, and assigns.

By purchasing the Workshops, you are agreeing to all of the following:

  1. Services Provided: Purchasing the Workshops entitles you to access monthly online workshops held live via videoconference (along with recordings and supplemental material) for the the four months  of September through December in the year of your purchase. Those monthly Workshops are tentatively scheduled to run on the second Saturday of each calendar month. The workshops begin at 9am pacific time and run from 3 to 6 hours depending on subject matter. The precise dates and times may be subject to change based upon various factors. You will receive advanced notice of the finalized dates and times for each workshop. You also receive bonus access to the AI With Integrity Workshop and the New Year Legal Priorities Workshop
  2. Your Responsibility/No Refunds: You understand that the Workshops involve complex subject matter that may present unfamiliar and difficult concepts. In addition, if you want to get the most value out of the Workshops, you will need to put in time and effort: (a) preparing in advance; (b) attending and paying attention on the day of the Workshops; and (c) implementing what you learned at the Workshops. You are agreeing to make all payments as set forth on this checkout page. And you understand that any and all payment(s) you make are nonrefundable, even if any workshop must be rescheduled.
  3. Email List: You understand that you must subscribe to the Workshops email list in order to receive emails that contain instructions on joining live, links to templates and outlines we may use, and any other information you may need for full participation in the Workshops.
  4. No Legal Services: The Workshops are not, and are not intended to be, legal services or advice. Likewise, any material we provide to supplement the Workshops -- including, but not limited to, presentation slides, worksheets, sample language, templates, outlines, checklists, and live and recorded content -- (collectively, "the Workshop Material") is not, and is not intended to be, legal services or advice. Rather, the Workshops and Workshop Material are intended to be educational in nature, and the instructor will take steps to ensure the educational nature of the Workshops are maintained.
  5. No Attorney-Client Relationship: Neither the Workshops nor any Workshop Material creates or evidences an attorney-client relationship between yourself and the instructor, Ian Foster, or PES LLC. The Workshops and the Workshop Material should not be seen as a substitute for advice from your attorney. Should you require legal advice, you will contact a licensed attorney in your area.
  6. Intellectual Property: The Workshops and Workshop Material are the work product and intellectual property of PES LLC. Purchasing the Workshops gives you the right to attend the Workshops online training, watch workshop recordings, and use the Workshop Material for your own business purposes only for the next 12 months. You will not give, sell, loan, or otherwise transfer the Workshop Material in any form to any other person or entity. You also will not portray yourself as the creator or owner of the Workshop Material.
  7. No Outcome Guaranteed: You understand and acknowledge that the law can be subtle, complicated, and differ from place to place. You further understand that all decisions in life and business come with a degree of risk and no outcome is certain. Therefore, PES LLC cannot promise or guarantee any particular outcome or result from your participation in the Workshops, and you will not hold PES LLC liable for the failure to attain any desired outcome or result from your purchase of, or participation in, the Workshops.
  1. No Promise of Tax Savings: You understand and acknowledge that tax laws are complex and highly fact-specific. Achieving tax savings and reducing audit risk both depend upon many factors. You understand and acknowledge that PES LLC cannot promise or guarantee that you will achieve any amount of tax savings, avoid any penalties, avoid an audit, or successfully defend an audit. You will not hold PES LLC liable for any failure to attain desired tax savings or avoid an audit or penalties.
  2. Liability Waiver: You agree that PES LLC will not be held liable for any damages or losses that you may incur, whether personal or business, as a direct or indirect result of actions or decisions that you take or do not take (a) in response to attending the Workshops or watching their recordings, (b) in response to reading, using, and/or misusing any of the Workshop Material, or (c) in response to any advice, answers, summaries, or action items that PES LLC may supply to you during the course of the Workshops.
  3. Indemnity: You will indemnify PES LLC against any and all liability to third parties arising from actions or decisions you take or do not take (a) in response to attending the Workshops or watching their recordings, (b) in response to reading, using, and/or misusing any of the Workshop Material, or (c) in response to any advice, answers, summaries, or action items that PES LLC may supply to you during the course of the Workshops.
  4. Confidentiality: PES LLC will take reasonable efforts to keep your contact and payment information private. In all other respects, PES LLC makes no promise of confidentiality.
  5. Consent to Recording: You understand that the Workshops will be recorded in audio and video format and you consent to such recordings. Access to the recordings will be limited to persons who register for one or more of the Workshops, as well as employees and agents of PES LLC for use in quality control. You are solely responsible for how you appear and/or sound on the calls and recordings. You agree to wear appropriate attire and to attend the calls in a location which is reasonably quiet and private. You will not use any virtual backgrounds containing any logos or other trademarked or copyrighted material that you do not own. If you use a virtual background containing trademarked, copyrighted, or proprietary material that you own, you hereby grant PES LLC an irrevocable license to display such material in the call recordings.

PES LLC has the right to dismiss you from any individual workshop and/or to cancel your Workshops subscription with no notice if you are disrespectful or disruptive, or if you violate another participant's confidentiality. You also agree to hold PES LLC harmless should another participant violate your confidentiality.
  7. Misuse & Violations: You understand and acknowledge that misuse of the Workshop Material and/or any violation of any of these Terms of Use will result in your immediate dismissal from the Workshops, the cancellation of your subscription, as well as appropriate legal action to protect PES LLC and its intellectual property rights.
