*Disclaimer and Terms of Use*

Please read the following Terms of Use carefully, as they are important and affect your rights. 

These Terms of Use serve as your contract for participation in Empowered Business Habits (hereinafter, "the Subscription"), which is created and operated by Personal Empowerment Services, LLC. In the these Terms of Use, the term "PES LLC" refers to Personal Empowerment Services, LLC, along with its owners, employees, contractors, agents, successors, and assigns.

By purchasing the Subscriptions, you are agreeing to all of the following:

1. Subscription: You are purchasing a monthly subscription for the price listed on the checkout page. You may cancel this subscription at any time by email us at [email protected]. If you cancel, your subscription will be active until the next renewal date.
2. Services Provided: Purchasing the Subscription entitles you to access morning check-in calls on weekdays along with weekly coaching and instruction calls each Friday. The daily check-in calls are scheduled to run from 6:30am to 7:00am pacific time on weekdays. Please note that some daily calls may be cancelled to due schedule conflicts or holidays. The weekly coaching and instruction calls are scheduled to run from 10:00am to 11:30am pacific time on Fridays. Again, note that some weekly calls may be cancelled to due scheduling conflicts and holidays. You will receive advanced notice of any cancellations or rescheduling.
3. Your Responsibility/No Refunds: You understand that the Subscription involves complex subject matter that may present unfamiliar and difficult concepts. In addition, if you want to get the most value out of the Subscription, you will need to put in time and effort to attending as many calls and possible and implementing what your learn. Any and all payment(s) you make are nonrefundable, even if any calls must be cancelled or rescheduled.
4. Email List: You understand that you must belong to the Subscription email list in order to receive emails that contain instructions on joining live, links to any bonuses, and any other information you may need for full participation in the Subscription.
5. Privileged Relationship: The Subscription does not create an attorney-client relationship or therapist-patient between yourself and the instructors, Ian Foster and Heather Foster. Should you require legal or therapeutic advice, you will contact a licensed attorney or therapist.
6. Intellectual Property: Any call recordings and other material included in your Subscription is the work product and intellectual property of PES LLC. Purchasing the Subscriptions gives you the right to attend the calls and use any bonus material for your own business purposes only while your Subscription is active. You will not give, sell, loan, or otherwise transfer any material or recordings to any other person or entity.
7. No Outcome Guaranteed: You understand and acknowledge that legal, business, and mindset issues can be subtle and complicated. You further understand that all decisions in life and business come with a degree of risk and no outcome is certain. Therefore, PES LLC cannot promise or guarantee any particular outcome or result from your participation in the Subscription, and you will not hold PES LLC liable for the failure to attain any desired outcome or result.

8. Liability Waiver: You agree that PES LLC will not be held liable for any damages or losses that you may incur, whether personal or business, as a direct or indirect result of actions or decisions that you take or do not take in response to attending any calls or using any material include in the Subscription.

1. Indemnity: You will indemnify PES LLC against any and all liability to third parties arising from actions or decisions you take or do not take in response to attending any calls or using any material included in the Subscription.
2. Confidentiality: In general, PES LLC will keep confidential any personal or business information you may share with us and will not share your information with any person outside of the Subscription without your consent. However, as there is no professional legal privilege, PES LLC makes no absolute promise of confidentiality. PES LLC may share your information in the following circumstances: (a) when required to comply with a valid subpoena or order from law enforcement, an administrative agency, or a court of competent jurisdiction; (b) when PES LLC forms a reasonable suspicion that you may be engaged in child abuse, elder abuse, or human trafficking; and (c) when PES LLC forms a reasonable suspicion that you may be about to cause harm to yourself or others.
3. Consent to Recording: You understand that calls included in the Subscription may be recorded in audio and video format and you consent to such recordings. Access to the recordings will be limited to persons who purchase the Subscription. You are solely responsible for how you appear and/or sound on the calls and recordings. You agree to wear appropriate attire and to attend the calls in a location which is reasonably quiet and private. You will not use any virtual backgrounds containing any logos or other trademarked or copyrighted material that you do not own. If you use a virtual background containing trademarked, copyrighted, or proprietary material that you own, you hereby grant PES LLC an irrevocable license to display such material in the call recordings.
4. Respectful Behavior: You agree to be respectful to other Subscription participants. You will treat your fellow participants with common courtesy and respect everyone's privacy and confidentiality. PES LLC has the right to dismiss you from any individual call and/or to cancel your Subscription with no notice if you are disrespectful or disruptive, or if you violate another participant's confidentiality. You also agree to hold PES LLC harmless should another participant violate your confidentiality.
5. Misuse & Violations: You understand and acknowledge that misuse of the Subscription material and/or any violation of any of these Terms of Use will result in your immediate dismissal from the Subscription, the cancellation of your Subscription, as well as appropriate legal action to protect PES LLC and its intellectual property rights.
6. Miscellaneous Terms:

• Should any portion of these Terms of Use be adjudicated invalid for any reason, it is the intent of the Parties that all remaining terms shall, to the extent possible, remain in effect. Further, it is the intent of the Parties that, to the extent practicable, these Terms should be interpreted so as to be valid and enforceable.
• These Terms of Use shall be interpreted under the laws of the State of California and without regard to conflict-of-law provisions. Any action to enforce any of these Terms must be brought in the County of Sonoma, State of California.
• These Terms of Use are the entire agreement between the Parties. No amendment to these Terms shall have effect unless made in writing and signed by both Parties
