*Disclaimer and Terms of Use*

Please actually read the following Terms of Use carefully. 

These Terms of Use serve as your contract for participation in Tax Law Made Easy (hereinafter, "the Program"), which is created and operated by Personal Empowerment Services, LLC. In the following Terms of Use, the term "PES LLC" refers to Personal Empowerment Services, LLC, along with its owners, employees, contractors, agents, successors, and assigns.

By purchasing the Program, you are agreeing to all of the following:

1. Services Provided: The Program consists of online video learning modules accompanied by various slides and worksheets.
2. Payments and Refunds. You agree to make all payment(s) associated with the payment plan you have chosen as reflected on the checkout page. You understand that the Program teaches a complex subject matter that may present unfamiliar and difficult concepts. The Program may require work and time on your part to understand and implement the content. As such, PES LLC makes no promise of satisfaction. Any and all payment(s) you make are nonrefundable.
3. Email List: You must confirm your subscription to the program email list in order to receive emails that contain any additional instructions, reminders, or future discount opportunities.
4. No Legal or Accounting Services: The Program is not, and is not intended to be, legal or accounting services or advice. Likewise, the material we provide to you during the course of the Program -- including, but not limited to, presentation slides, worksheets, sample language, templates, and any live or recorded audio or video -- (collectively, "the Program Material") is not, and is not intended to be, legal or accounting services or advice. Rather, the Program and Program Material are intended to be educational in nature, and the instructor will take steps to ensure the educational nature of the program is maintained.
5. No Attorney-Client Relationship: Neither the Program nor any Program Material creates or evidences an attorney-client relationship between yourself and the instructor, Ian Foster, or PES LLC. The Program and the Program Material should not be seen as a substitute for advice from your attorney or accountant. Should you require legal or accounting advice, you will contact a licensed attorney or accountant in your area.
6. Intellectual Property: The Program and Program Material are the work product and intellectual property of PES LLC. Purchasing the Program gives you the right to attend/watch the Program's online training modules and use the Program Material for your own business purposes only. The Program Material may be used by yourself, your business partners, and your employees/contractors for the purposes of furthering the goals of the Program and your business. You will not give, sell, loan, or otherwise transfer the Program Material in any form to any other person or entity. You also will not portray yourself as the creator or owner of the Program Material.
7. Proprietary Terms of Use: These Terms of Use are the intellectual property of PES LLC and are specifically designed to protect both you and PES LLC in the context of the Program you have purchased. These Terms of Use are not suitable for any other purpose and indeed may cause legal harm if used in any other context. You will not copy, modify, use, give, or sell these Terms of Use for any reason.
8. No Outcome Guaranteed: You understand and acknowledge that all decisions in life and business come with a degree of risk and no outcome is certain. You understand and acknowledge that PES LLC cannot promise or guarantee any particular outcome or result from your participation in the Program. You will not hold PES LLC liable for the failure to attain an desired outcome or result from your participation in the Program.
9. No Promise of Tax Savings: You understand and acknowledge that tax laws are complex and highly fact-specific. Achieving tax savings and reducing audit risk both depend upon many factors. You understand and acknowledge that PES LLC cannot promise or guarantee that you will achieve any amount of tax savings, avoid any penalties, avoid an audit, or successfully defend an audit. You will not hold PES LLC liable for any failure to attain desired tax savings or avoid an audit or penalties.
10. Liability Waiver: You agree that PES LLC will not be held liable for any damages or losses that you may incur, whether personal or business, as a direct or indirect result of actions or decisions that you take or do not take (a) in response to watching any of the Program's modules, (b) in response to reading, using, and/or misusing any of the Program Material, or (c) in response to any advice, answers, summaries, or action items that PES LLC may supply to you during the course of the program or in any Facebook group.
11. Indemnity: You will indemnify PES LLC against any and all liability to third parties arising from actions or decisions you take or do not take (a) in response to watching any of the Program's modules, (b) in response to reading, using, and/or misusing any of the Program Material, or (c) in response to any advice, answers, summaries, or action items that PES LLC may supply to you during the course of the program or in any Facebook group.
12. Confidentiality: PES LLC makes no absolute promise of confidentiality with regard to any participation in the Program.
13. Misuse & Violations: You understand and acknowledge that misuse of the Program Material and/or violations of any of these Terms of Use will result in your immediate dismissal from the Program as well as appropriate legal action to protect PES LLC and its intellectual property rights.
14. Miscellaneous Terms:

1. Should any portion of these Terms of Use be adjudicated invalid for any reason, it is the intent of the Parties that all remaining terms of this Agreement shall, to the extent possible, remain in effect. Further, it is the intent of the Parties that, to the extent practicable, these Terms should be interpreted so as to be valid and enforceable.
2. These Terms of Use shall be interpreted under the laws of the State of California and without regard to conflict-of-law provisions. Any action to enforce any of these Terms must be brought in the County of Sonoma, State of California.
3. These Terms of Use are the entire agreement between the Parties. No amendment to these Terms shall have effect unless made in writing and signed by both Parties
