Basic Legal Course for Energy Healers

Please actually read the following Terms of Use carefully. You are, after all, going to be learning about the law! These Terms of Use serve as your contract for participation in the Basic Legal Course for Energy Healers (hereinafter, "the Program"), which is created and operated by Personal Empowerment Services, LLC.

In the following Terms of Use, the term "PES LLC" refers to Personal Empowerment Services, LLC, along with its owners, employees, contractors, agents, successors, and assigns.

By purchasing the Program, you are agreeing to all of the following:

1. Services Provided: The Program consists of an online introductory video, six online video learning modules, periodic live Q&A calls via videoconference, and recordings of the six most recent Q&A calls.
2. Program Access: You will have access to the Program for 180 days from the date of purchase. After 180 days, your access will be revoked.
3. Credit for Program Completion: Discover Healing, Inc., in their sole discretion, may choose to issue continuing education credits to those who complete the Program. PES LLC has no control over, and makes no promises regarding, whether Discover Healing chooses to issue such credits. To the extent you desire to be credited for completing the Program, you must: (a) watch all the online video learning modules (including the introductory video) in their entirety; and (b) attend a minimum of two live Q&A calls. In order to get credit for your required Q&A call attendance, you must show up to the call no more than 15 minutes after the call begins and remain on the call until it ends. Anyone who arrives more than 15 minutes late will not be allowed to join the Q&A call.
4. Q&A Call Schedule: The live Q&A calls will be scheduled at staggered dates and times in order to accommodate people in multiple time zones You will receive periodic notice of upcoming call times, as well as reminders before the start of each call. The call times are subject to change on short notice. Each call will last approximately two hours. There will be no more than two live Q&A calls per month, which means you will have no more than 12 chances to attend your required two calls before you lose access to the course. It is your responsibility to budget your time accordingly and make time to attend the calls.
5. No Refunds: You understand that the Program teaches a complex subject matter that may present unfamiliar and difficult concepts. The Program may require effort to understand and implement the content, and will require you to set aside time to watch the video content and attend the Q&A calls. You are solely responsible for putting in the time and effort. As such, PES LLC makes no promise of satisfaction. Any and all payment(s) you make are nonrefundable.
6. Email List: You understand that you must confirm your subscription to the Program email list in order to receive emails that contain instructions on joining the Q&A calls and any other information you may need for full participation in the Program. Please add [email protected] to your address book to ensure receipt of the emails. If you fail to confirm your email subscription, you will be unable to participate fully in the course and may not receive credit for completion.
7. No Legal Services: The Program is not, and is not intended to be, legal services or advice. Likewise, the material we provide to you during the course of the Program -- including, but not limited to, presentation slides, video modules, worksheets, sample language, outlines, and both live and recorded audio and video -- (collectively, "the Program Material") is not, and is not intended to be, legal services or advice. Rather, the Program and Program Material are intended to be educational in nature, and the instructor will take steps to ensure the educational nature of the Program is maintained.
8. No Attorney-Client Relationship: Neither the Program nor any Program Material creates or evidences an attorney-client relationship between yourself and the instructor, Ian Foster, or PES LLC, or Discover Healing, Inc. The Program and the Program Material should not be seen as a substitute for individualized advice from your attorney. Should you require legal advice, you will contact a licensed attorney in your area. You will not hold PES LLC or Discover Healing, Inc. liable for your failure to consult a licensed attorney.
9. Proprietary Program and Material: The Program and Program Material are the work product and intellectual property of PES LLC. Purchasing the Program gives you the right to attend/watch the Program's online training modules and Q&A calls and use the Program Material for your own business purposes only. The Program Material may be used by yourself, your business partners, and your employees/contractors for the purposes of furthering the goals of the Program and your business. You will not give, sell, loan, or otherwise transfer the Program Material in any form to any other person or entity. You also will not portray yourself as the creator or owner of the Program Material.

10. Trademarked Material: The Emotion Code and The Body Code are the trademarked and proprietary material of Discover Healing, Inc. You will not use Discover Healing's intellectual property except as allowed in your agreement with Discover Healing.

1. Proprietary Terms of Use: These Terms of Use are the intellectual property of PES LLC and are specifically designed to protect both you and PES LLC in the context of the Program you have purchased. These Terms of Use are not suitable for any other purpose and indeed may cause legal harm if used in any other context. You will not copy, modify, use, give, or sell these Terms of Use for any reason.
2. No Outcome Guaranteed: You understand and acknowledge that all decisions in life and business come with a degree of risk and no outcome is certain. You understand and acknowledge that neither PES LLC nor Discover Healing, Inc. can promise or guarantee any particular outcome or result from your participation in the Program. You will not hold PES LLC or Discover Healing, Inc. liable for any failure to attain any desired outcome or result from your participation in the Program.
3. Liability Waiver: You agree that you will not hold PES LLC or Discover Healing, Inc. liable for any damages or losses that you may incur, whether personal or business, as a direct or indirect result of actions or decisions that you take or do not take (a) in response to attending or watching any of the Program's modules or Q&A calls, (b) in response to reading, using, and/or misusing any of the Program Material, or (c) in response to any advice, answers, summaries, or action items that PES LLC may supply to you during the course of the Program.
4. Indemnity: You will indemnify both PES LLC and Discover Healing, Inc. against any and all liability to third parties arising from actions or decisions you take or do not take (a) in response to attending any of the Program's modules or Q&A calls, (b) in response to reading, using, and/or misusing any of the Program Material, or (c) in response to any advice, answers, summaries, or action items that PES LLC may supply to you during the course of the Program.
5. Consent to Recordings: You understand that, by participating in the Program, you may be recorded on audio and/or video format during the Q&A calls. You consent to such recording and you consent to PES LLC using such recording for future training and/or educational purposes with clients, as well as internal review purposes so that we can improve the Program. You are solely responsible for how you appear and/or sound on the calls and recordings. You agree to wear appropriate attire and to attend the calls in a location which is reasonably quiet and private. You will not use any virtual backgrounds containing any logos or other trademarked or copyrighted material that you do not own. If you use a virtual background containing trademarked, copyrighted, or proprietary material that you own, you hereby grant PES LLC an irrevocable license to display such material in the call recordings.
6. Confidentiality: In general, PES LLC will keep confidential any personal or business information you may share during the course of the Program, and will not share your information with third parties without your consent. However, as there is no legal privilege, PES LLC makes no absolute promise of confidentiality. PES LLC may share your information in the following circumstances: (a) when required to comply with a valid subpoena or order from law enforcement or a court of competent jurisdiction; (b) when PES LLC forms a reasonable suspicion that you may be engaged in child abuse, elder abuse, or human trafficking; (c) when PES LLC forms a reasonable suspicion that you may be about to cause harm to yourself or others; and (d) in order to inform Discover Healing, Inc. of your successful completion of the Program.
7. Respectful Behavior: You agree to be respectful to other Program participants. You will treat your fellow Program participants with common courtesy and respect everyone's privacy and confidentiality. PES LLC has the right to dismiss you from the Program with no notice if you are disrespectful or disruptive during the live Q&A calls, or if you violate another participant's confidentiality. You also agree to hold PES LLC harmless should another participant violates your confidentiality.
8. Misuse & Violations: You understand and acknowledge that misuse of the Program Material and/or violations of any of these Terms of Use will result in your immediate dismissal from the Program as well as appropriate legal action to protect the rights of PES LLC and Discover Healing, Inc. If you are dismissed for misuse or violating these Terms, you will receive no refund and no credit for completing the Program.
9. Miscellaneous Terms:

• Should any portion of these Terms of Use be adjudicated invalid for any reason, it is the intent of the Parties that all remaining terms of this Agreement shall, to the extent possible, remain in effect. Further, it is the intent of the Parties that, to the extent practicable, these Terms should be interpreted so as to be valid and enforceable.
• These Terms of Use shall be interpreted under the laws of the State of California and without regard to conflict-of-law provisions. Any action to enforce any of these Terms must be brought in the County of Sonoma, State of California.
• These Terms of Use are the entire agreement between the Parties. No amendment to these Terms shall have effect unless made in writing and signed by both Parties
