*Disclaimer and Terms of Use*

These Terms of Use serve as your contract for access to and participation in the Actualize Your Goals coaching program which is created and operated by Personal Empowerment Services, LLC.

In these Terms of Use, the following definitions apply:

• "PES LLC" refers to Personal Empowerment Services, LLC, along with its owners, employees, contractors, agents, successors, and assigns.
• “Program” refers to the Actualize Your Goals coaching program.
• “Program Material” refers to any live or reproduceable material provided to you during the Program, including, but not limited to: presentation slides, worksheets, both live and recorded audio and video, and any written content created by PES LLC.

By purchasing the Program, you are agreeing to all of the following:

1. The Program and Program Material are not, and should not be construed as: (a) legal services or advice, (b) psychological services or advice, or (c) therapeutic services or advice. The Program and Program Material are educational in nature. You are responsible for how you respond to/act upon what you learn in the Program.
2. Neither the Program nor any Program Material creates or evidences an attorney-client or therapist-client relationship between yourself and PES LLC.
3. We intend to respect your privacy to the best of our ability and will take reasonable measures to protect the confidentiality of anything you communicate during the course of the Program. However, you acknowledge that, because there is no attorney-client or therapist-client privilege, we may be required to divulge your information or communications when require by law. Circumstances under which we may have to divulge your information or communications to third parties include, but are not necessarily limited to: (a) when PES LLC is properly subpoenaed; (b) when PES LLC is ordered to do so by a court or law enforcement agency of competent jurisdiction; (c) when PES LLC reasonably suspects the existence of child or elder abuse; and/or (d) when PES LLC reasonably suspects that you may imminently harm yourself or others.
4. You agree to respect other Program participants and treat them with common courtesy. You also agree to respect the privacy and confidentiality of other Program participants.
5. The Program and Program Material are the work product and intellectual property of PES LLC. Purchasing the Program gives you the right to attend/watch live calls and use the Program Material for your own purposes. You will not give, sell, loan, or otherwise transfer the Program Material in any form to any other person or entity. You also will not portray yourself as the creator or owner of the Program Material.
6. You understand and acknowledge that all decisions in life and business come with a degree of risk and no outcome is certain. You understand and acknowledge that PES LLC cannot promise or guarantee any particular outcome or result from your participation in the Program. You will not hold PES LLC liable for the failure to attain an desired outcome or result from your participation in the Program.
7. You agree that PES LLC will not be held liable for any damages or losses that you may incur, whether personal or business, as a direct or indirect result of actions or decisions that you take or do not take (a) in response to attending or watching any of the Program's calls or online modules, (b) in response to reading, using, and/or misusing any of the Program Material, or (c) in response to any advice, summaries, or action items that PES LLC may supply to you during the course of the program.
8. You will indemnify PES LLC against any and all liability to third parties arising from actions or decisions you take or do not take (a) in response to attending or watching any of the Program's calls or online modules, (b) in response to reading, using, and/or misusing any of the Program Material, or (c) in response to any advice, summaries, or action items that PES LLC may supply to you during the course of the program.
9. You understand that, by participating in the Program, you may be recorded on audio and/or video format during group coaching calls and/or at live events. You consent to such recording and you consent to PES LLC using such recording for future training and/or educational purposes with clients, as well as internal review purposes so that we can improve the Program. You understand that you are responsible for your appearance and for what you choose to say on such recordings. It is not PES LLC’s intent to record your private coaching calls, unless you ask us to do so.
10. You understand and acknowledge that misuse of the Program Material or violations of any of these Terms of Use will result in appropriate legal action to protect PES LLC and its intellectual property rights.
